Cannabis and Cannabidiol in the UK / GB / Ireland (5 August 2017)
CBD is legal in the UK if sold as a food supplement. CBD products that are produced using Cannabis Sativa L. (hemp) are able to be legally sold as food supplements. The Food Supplements Directive 2002/46/EC defines a food supplement as foodstuffs which supplement a normal diet and which are concentrated sources of nutrients or other substances with a nutritional or physical effect.
The UK MHRA (Medicines and Healthcare products Regulatory Agency) have stated that “products containing cannabidiol (CBD) used for medical purposes are a medicine. Medicinal products must have a product licence (marketing authorisation) before they can be legally sold, supplied or advertised in the UK“
The MHRA goes on to say that any product that makes medicinal claims and is used for medical purposes is classified as medicinal product and therefore would need marketing authorisation.
On the other hand the MHRA have not stated that CBD used as a food supplement will require a marketing authorisation. Just that CBD used as a medicine require a marketing authorisation.
SO DOES CBD REQUIRE A MARKETING AUTHORISATION FROM THE MHRA OR NOT?
Providing a CBD product is sold as a food supplement and does not make any medicinal claims, it is legally able to be sold in the UK. If the effects of the consumption of a food supplement is no different to that linked to the consumption of hemp as a foodstuff, it cannot be classified as a medicine and does not need marketing authorisation to be sold in the UK.
Importation of CBD products for personal use or use by a member of your household
The relevant legislation can be read at this link – Human Medicines Regulations 2012 (‘the Regulations’), which are concerned primarily with the regulatory framework for the production, supply and licensing of medicinal products. This is about controlling the mechanisms of a market and not, as the case is with the Misuse of Drugs Act 1971 (‘the 1971 Act’), predominantly prohibiting activities related to a whole class of drugs (although many controlled drugs are also medicines subject to the 2012 Regulations). A breach of the Regulations can be a criminal offence carrying a maximum of two years’ in prison.
The 2012 Regulations are not concerned with individual use of a medicinal product, so personal possession of CBD is considered not to be a criminal offence.
In terms of importation, of a medicinal product, Regulation 17 paragraph (1) states:
“A person may not, except in accordance with a licence (a ‘manufacturer’s licence’)—
(a) manufacture, assemble or import from a state other than an EEA State [European Economic Area] any medicinal product; or
(b) possess a medicinal product for the purpose of any activity in sub-paragraph (a).”
Regulation 17(6) states:
“Paragraph (1) does not apply to a person who imports a medicinal product for administration to himself or herself or to any other person who is a member of that person’s household.”
SO IS CBD LEGAL IN THE UK?
Yes it is. CBD is not a controlled drug under the Misuse of Drugs Act 1971 and it is not covered by the Psychoactive Substances Act 2016. As long as it is marketed as a food supplement without any medicinal claims it is perfectly legal to sell and to buy.
