INDIANA CBD LAWS – UPDATE – FEBRUARY 2018
INDIANAPOLIS –The Indiana Legislature is about to enact state laws that will allow anyone to use cannabidiol (CBD Oil). The Indiana Senate initially voted 35-13 to allow cannabidiol to be sold without restriction. The Indiana House previously approved similar legislation. A law passed last year allowed those with a severe form of epilepsy to use the substance. This marks a major shift in policy over a short period of time when it comes to Cannabis or Cannabis-derived products.

Unfortunately, the state of Indiana has been slow to enact cannabis law reform despite support from its constituents. Recreational cannabis possession in any amount is still a serious crime in the state, and efforts to legalize medical cannabis in the state have gained little traction within the legislature.

Karen Tallian introduced a medical cannabis bill in 2016, but the Indiana General Assembly concluded in 2016 session without making any progress.

Little effort by Indiana lawmakers to reduce penalties for recreational cannabis. Possession of any amount of cannabis in is charged as a Class A misdemeanor, punishable by 180 days in jail with a fine of $1,000. Possession of under 30 grams with a prior drug offense gets 1 year in jail and $5,000 in fines. Possession of over 30 grams (with a prior drug offense) is a felony, attracting up to 2.5 years in prison and $10,000. First-time offenders may get a conditional discharge with probation over jail time and have the charges expunged from their record. Selling less than 30 grams of cannabis is a misdemeanor gets you a year in prison and a $5,000 fine. Sale of higher quantities is a felony with up to 6 years in jail and $10,000 in fines. In Indiana, even being in the presence where knowledge of drug activity occurs is a misdemeanor, punishable by 6 months incarceration and a $1,000 fine.
Cultivation of Cannabis in Indiana
Personal cannabis cultivation is illegal in Indiana. The state does authorize the production of industrial hemp for commercial and research purposes via a bill passed in 2014. Indiana’s University of Purdue has led industrial hemp cultivation programs since the law passed.

About Indiana (IN)
Following the end of the Ice Age, around 8000 BC, Paleo-Indians arrived in the region, now Indiana, becoming its first inhabitants. The people were mainly in small nomadic groups, who hunted large game such as mastodons. They created stone tools knapped from chert. The Woodland period (1500 – 700BC) new cultural attributes developed. People in this period people created ceramics and pottery and began to cultivate plants. The Adena people had elegant burial rituals that featured log tombs beneath earth mounds. The Hopewell people from this time began to trade goods from longer distances. Corn and squash were developed as high production crops and agriculture became predominant in this period.
Around 1000 AD the Mississippian culture emerged and remained till the 15th century, just before the arrival of Europeans in America. At this time people created large urban settlements designed according to cosmology. These included large mounds and plazas containing ceremonial and public spaces including the Angel Mounds. These public areas were where leaders lived or conducted rituals. The Mississippian civilization mysteriously collapsed in the mid-15th century. The languages spoken by Native American tribes in the area at the time of European settlement were variations of Algonquian, spoken by tribes such as Shawnee, Miami, and Illini. Later these tribes were joined by others fleeing eastern regions including the Delaware who settled in the White and Whitewater River Valleys.
