About New Jersey (NJ)
From 2800 years ago New Jersey was inhabited by Native Americans such as the Lenape who lived along the coast. Dutch and the Swedish settlers arrived in the early 17th century. New Jersey continues to undergo cannabis reform despite having a mostly unsupportive governor. NJ has broadened its medical cannabis laws and is working toward legislation that will legalize, or at least decriminalize, adult use ofcannabis.
Medical Cannabis in New Jersey
In 2010 New Jersey lawmakers legalized medical cannabis in the passing of Senate Bill 119. The program has, however, been criticized for its slow progress. 2012 saw the the opening of patient registration but the very limited list of qualifying conditions and a lack of operational dispensaries have hampered the program.
Patients that qualify for the program can possess up to 2 oz. of cannabis per month, but may not cultivate it themselves.
Patients up to 18 years that suffer from an approved debilitating medical condition can register for the state’s medical cannabis program. New Jersey Governor Chris Christie signed legislation in 2015 allowing qualified minor patients to consume their medicine while on school grounds.
Governor Christie also signed Assembly Bill No. 457 in 2016 to expand the law to include post-traumatic stress disorder (PTSD) as a debilitating medical condition so authorizing the the use of medical Cannabis. Recreational Cannabis in New Jersey
Recreational cannabis is still illegal in New Jersey and possession of less than 50 grams of cannabis in the state is can get you a sentence of 6 months in prison and a fine up to $1,000. Possession of amounts over 50 grams is a 4th degree crime and will attract a penalty of up to 18 months prison and a $25,000 fine.
Bills to tax and regulate cannabis were introduced in the New Jersey Assembly by lawmakers in 2016, but Gov. Christie has said he would veto any attempt to legalize recreational cannabis.
Cultivation of Cannabis in New Jersey
Cultivation of cannabis in New Jersey for personal or medical purposes is currently illegal. Growing less than 10 plants can get three to five years prison and a fine of up to $25,000.
New Jersey has yet to pass industrial hemp cultivation laws, so growing hemp also remains illegal.
